Core Devices LLC Privacy Policy

This Privacy Policy applies to all information Core Devices LLC (“we”) collects about you through our rePebble.com website, the Pebble operating system and mobile applications, and related Core Devices online services (collectively, "Core Devices”).
Privacy is a fundamental human right. We will uphold the privacy of our users by fighting against ads, trackers and other impingements on privacy. We will never profit by monetizing your data but instead seek to fulfill our company mission by delivering a great product & service. Our commitment to privacy and data protection is reflected in this Privacy Statement which describes how we collect and process "personal information" that identifies you, like your name or email address. Any other information besides this is "non-personal information." If we store personal information with non-personal information, we'll consider that combination to be personal information. Only if we remove all personal information from a set of data would we consider the remainder non-personal information.
What Information Do We Collect?
We collect information from or about you, such as when you create a Core Devices account, use Core Devices, contact us or from other sources, such as when you log into your account with a third-party social media service. The information we collect includes the following:
- Identifiers. Username, first and last name.
- Profile Information. Social media profile name and profile picture.
- Contact Information. Email address, phone numbers.
- Contacts: You may grant Core Devices permission to access your contacts. This contact information is only stored on-device.
- Location Information. We collect (but do not transfer or upload) precise geolocation information in our mobile application. We collect and store IP addresses of our website visitors and users of our mobile applications, and use that to infer the approximate location of our users.
- Internet and mobile network activity information. We automatically collect logs and performance information, including browser type, IP address, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information, performance metrics, website engagement metrics, and error and crash data.
- Inferences. We make certain inferences about you and your use of Core Devices, such as your approximate location from your IP address, and the likelihood of retention or attrition.
- Information you directly provide it to us. This may include phone number, SMS, contacts, video, audio, photos and other data uploaded to our services.
How Do We Use Your Information?
We use your information for the following business purposes:
- Provide the Core Devices service. We use your information to operate Core Devices; contact you about important product information, such as changes to our Terms of Use ("Terms") and Privacy Policy and updates to Core Devices; provide customer support; troubleshoot bugs or errors; improve Core Devices products and services; test new features; detect and protect against malicious, deceptive, fraudulent, or illegal activity; and better understand your online and mobile phone activity while using Core Devices products and services.
- Marketing. We may send marketing communications to you using your contact information. You may request that we stop sending you direct marketing communications which you have previously consented to receive. We may continue to send you service-related and other non-marketing communications.
- Legal Reasons. We may use your information to assist with enforcement of our Terms, this Privacy Policy, and other agreements, for legal compliance reasons, and to otherwise protect the rights and property of Core Devices and others.
Information Sharing
We share information about you:
- when we've asked & received your consent to share it
- as needed to process or provide services or products to you, but only if those entities agree to provide at least the same level of privacy protection we're committed to under this Privacy Statement
- to comply with laws or to respond to lawful requests and legal process, provided that we'll notify you unless we're legally prohibited from doing so. We'll only release personal information if we believe in good faith that it's legally required
- only if we reasonably believe it's necessary to prevent harm to the rights, property or safety of you or others
- in the event of a corporate restructuring or change in our organizational structure or status to a successor or affiliate
Information Protection
Core Devices LLC implements physical, business and technical security measures to safeguard your personal information. In the event of a security breach, we'll notify you so that you can take appropriate protective steps. We only keep your personal information for as long as is needed to do what we collected it for. After that, we destroy it unless required by law.
Use of Cookies
We use cookies in order to provide better service, to track usage of Core Devices, and to address certain security issues. We do not use cookies for profiling or advertising. When you access Core Devices, we send the cookies to your computer or phone. The cookies help us keep track of your visits and your activity on Core Devices and to understand how you interact with us.
Other Information
As part of our normal operations, your information may be stored in computers in other countries outside of your home country. By giving us information, you consent to this kind of information transfer. Irrespective of where your information resides, we'll comply with applicable law and abide by our commitments herein.
We don't want your personal information if you're under 13. Do not provide it to us. If your child is under 13 and you believe your child has provided us with their personal information, please contact us to have such information removed.
Privacy Rights Under the General Data Protection Regulation ("GDPR")
If you are a resident of the European Economic Area ("EEA"), United Kingdom or Switzerland (collectively, "Europe"), data protection laws give you certain rights with respect to your personal data, subject to any exemptions provided by the law, including the rights to:
- Request access to your personal data;
- Request correction or deletion of your personal data;
- Object to our use and processing of your personal data;
- Request that we limit our use and processing of your personal data; and
- Request portability of your personal data.
You also have the right to make a complaint to a government supervisory authority. You can make requests by emailing privacy@rePebble.com.
U.S. Privacy Rights
Laws in some US states require us to provide residents with additional information about the categories of personal information we collect and share, where we get that personal information, and how and why we use it. You'll find that information in this section (if you are a California resident, please note that this is the Notice at Collection we are required to provide you under California law).
In the last 12 months, we collected the following categories of personal information:
- Identifiers (like your name, contact information, and device and online identifiers);
- Commercial information (your billing information and purchase history, for example);
- Internet or other electronic network activity information (such as your usage of Core Devices products and services);
- Geolocation data (such as your approximate location based on your IP address);
- Audio, electronic, visual or similar information (such as your profile picture); and
- Inferences we make (such as likelihood of retention or attrition).

We collect personal information for the business and commercial purposes described in the How Do We Use Your Information? section. And we share this information with the categories of third parties described in the Information Sharing section. We retain this information for the length of time described in our Information Protection section.
In some US states you have additional rights subject to any exemptions provided by your state's respective law, including the right to:
- Request a copy of the specific pieces of information we collect about you and, if you're in California, to know the categories of personal information we collect, the categories of business or commercial purpose for collecting and using it, the categories of sources from which the information came, and the categories of third parties we share it with;
- Request deletion of personal information we collect or maintain;
- Request correction of personal information we collect or maintain;
- Opt out of the "sale" or "sharing" or "targeted advertising" of personal information;
- Receive a copy of your information in a readily portable format; and
- Not receive discriminatory treatment for exercising your rights.

Changes
We may need to change this privacy statement and our notices from time to time. Any updates will be posted online with an effective date. Continued use of our services after the effective date of any changes constitutes acceptance of those changes.
